O'Neill "Enter to Win" Sweepstakes Rules and Regulations OFFICIAL RULES: 1. HOW TO ENTER: The “Keith Lidberg” sweepstakes period begins at 12:00AM (PST) on 3/7/08 and ends 5:00 PM (PST) on 4/4/08. In order to participate you can register on the www.oneill.com homepage link listed as the "Keith Lidberg” sweepstakes online form and follow the instructions to enter. Once the required registration information is received by O’Neill within the time frame required by these Official Rules, you will be entered into the random drawing. There will be one grand prize winner chosen at the end of the sweepstakes period. The person who is the authorized email account holder of the email address indicated when registering a screen name will be deemed the entrant. Email addresses cannot be shared. The authorized email account holder is the natural person who is assigned to the email address by an Internet access provider, online service provider, or other organization that is responsible for assigning email addresses, or the domain associated with the submitted email address. Except for printed online forms, no mechanically reproduced entries accepted. Limit one entry per person per Season and per email address. 2. RANDOM DRAWING: Entries must be received at O'Neill between 8:00 AM (PST) on the first day of the sweepstakes period and 5:00PM (PST) on the last day of the sweepstake period to be eligible for the sweepstakes drawing. The winner will be selected in a random drawing on or about fifteen (15) days after the close of the sweepstakes period. The prize for the “Keith Lidberg” sweepstakes is a promotional package consisting of one (1) autographed wakeboard and two (2) pair of boardshorts. The prize available for the sweepstakes is entirely within O'Neill's absolute discretion. No cash or other prize substitution except by O'Neill which reserve right to substitute, in whole or in part, a prize of comparable or greater value if stated prize should not be available. Prizes are not transferable. Winners are solely responsible for all taxes on prizes and any expenses relating to accepting and using a prize unless such expenses are specifically included in the prize description. All drawings are final and binding on all matters related to the giveaway. Decisions of judges are final. Odds of winning the Season’s drawing will depend upon the number of eligible entries received. Only one prize per grand prize winner for the entire sweepstakes period. Winner need not be present and will be notified by e-mail or phone within seven to ten (7-10) calendar days of their name being drawn (For example, if the sweepstakes winner is picked September 5th, he/she will be notified approximately September 14, 2008). Upon notification, winners must claim their prizes by e-mail or by the telephone number 949.428.2912. If a given winner does not respond by 5:00pm (PST) seven (7) calendar days after initial notification (e.g., if winner receives notification by September 14, winner must respond by 5:00PM (PST) September 21, 2008), an alternate winner will be selected at random from among remaining eligible entries. Winners must complete any and all legal documents, including without limitation an Affidavit of Eligibility and Release of Claims, and return them to O’Neill by 5:00pm (PST) within seven (7) calendar days after receipt of such documents. Noncompliance will result in disqualification of the winner, and an alternate winner will be selected from among remaining eligible entries by random drawing. Prize(s) will be sent to eligible winners within fourteen (14) calendar days after receipt by O'Neill of the legal documents from winner, and verification by O'Neill thereof. 3. GENERAL RULES: NO PURCHASE NECESSARY. VOID WHERE PROHIBITED BY LAW. Open only to U.S. residents who are 13 years of age or older as of January 1st, 2008. O'Neill is not responsible for faulty, incorrect email transmissions, incorrect announcements of any kind, technical hardware or software failures of any kind including any injury or damage to any person's computer related to or resulting from participating in or experiencing any materials in connection with the promotion, lost or unavailable network connections, or failed, incomplete, garbled or delayed computer transmission that may limit a user's ability to participate in the sweepstakes; or any error that may occur in the processing of "Keith Lidberg” sweepstakes account registrations. O'Neill assumes no responsibility for undeliverable emails resulting from any form of active or passive email filtering by a user's internet service provider and/or email client or for insufficient space in user's email account to receive email. It is the participant's responsibility to register with a valid email and mailing address. O'Neill is also not responsible for lost mail, mail that is undelivered by the carrier of your choice, or any mail that is not received at 17 Pasteur, Irvine, CA 92618 by 5:00 PM (PST) on the last day of the sweepstake period to be valid for the sweepstakes drawing. O'Neill reserves the right to cancel or modify the promotion if fraud, misconduct or technical failures destroy the integrity of the promotion or if a computer virus, bug, or other technical problem corrupts the administration, security, or proper administration of the program as determined by sponsor/judging agency/administrator, in their sole discretion. In the event of termination of the sweepstakes, a notice will be posted online. Any damage made to the website will also be the responsibility of the authorized email account holder of the email address submitted at the time of entry. Participant shall be requested to provide O'Neill with proof that the participant is the authorized email account holder of the email address associated with the account/submission. Proof of sending will not be deemed to be proof of receipt by O'Neill. O'Neill reserves the right to freeze or close an account or to prohibit the participation of an individual/account holder if fraud or tampering is suspected or if the account holder fails to comply with any requirement of participation as stated herein or with any provision in these Official Rules. All federal, state and local laws apply. 4. CONDITIONS OF PARTICIPATION: By participating in the "Keith Lidberg” sweepstakes, participants agree (1) to abide by these Official Rules and the decisions of O’Neill and its agents, including the judges, which decisions shall be final in all matters relating to the sweepstakes; (2) to release and hold harmless and indemnify O'Neill, and each of its respective parent, affiliates, subsidiaries, advertising and promotion agencies, the judges, and all other individuals or entities involved in the creation, administration, or fulfillment of the sweepstakes, and their respective directors, officers, employees, and agents from any and all liability with respect to their participation in the sweepstakes and the possession, acceptance, use/misuse of any drawing merchandise or prize; and (3) that neither O'Neill, nor its agents have made any representation, warranty or guaranty, expressed or implied, in fact or in law, relating to the sweepstakes merchandise.
